Rachel B. Goodman is a partner with Foley & Lardner LLP, and a member of the firm’s Health Care Practice Group and national Telemedicine & Digital Health Industry Team. Rachel provides strategic and creative advice, helping health care clients build and scale their businesses nationally. From transactional and regulatory counseling to serving as outside general counsel, she creates and implements scalable strategies and programs with a focus on proactive, practical compliance and cost-effective legal solutions. Rachel has been recognized by Chambers USA: America’s Leading Business Lawyers (2024).
Rachel is dedicated to representing an array of clients nationally with transactional and related regulatory issues including health care providers, physician groups, hospitals, health systems, pharmacies, laboratories, home health agencies, skilled nursing facilities, assisted living facilities, rehabilitation agencies, durable medical equipment suppliers, pharmaceutical companies, health care IT companies, health care industry vendors, investors, private equity firms and their portfolio companies, entrepreneurs and startups.
She has considerable experience in matters involving fraud and abuse compliance, including self-referral and anti-kickback laws, corporate compliance programs, Medicare and Medicaid reimbursement, self-disclosures and overpayments, health information privacy, behavioral health, health care marketing, licensing, change of ownership, enrollment and corporate and transactional matters involving mergers, acquisitions, due diligence, joint ventures and other strategic affiliations. She implements compliance programs and policies, as well as HIPAA policies and procedures for health care entities of all sizes. She is known for her tried and trusted work ethic, handling internal investigations, and strategizing for responses to DOJ inquires and actions.
Rachel has a robust telemedicine and digital health practice in which she and Foley’s Digital Health Team serve as outside general counsel for clients on a variety of diverse matters. They have helped clients build and develop virtual care platforms, expand telehealth capabilities in the U.S., create and launch clinical trial groups, develop state-by-state telemedicine modalities and practice standards, which have allowed her clients to give their patients and providers better control over their health care needs through remote monitoring and digital health treatments.
Rachel regularly advises her clients on negotiating strategic partnerships that allows their patients to connect through AI-powered apps that allows them to obtain on-demand medical care (and allows the client to incorporate existing electronic medical records). She also helps her clients integrate their platforms to become full-fledged telemedicine platforms, transform their offerings to comprehensive direct-to-consumer virtual care platforms, and helping telemedicine clients with transactions and financing matters.
Rachel also works regularly with investors, entrepreneurs and startup businesses in the health care arena, and she advises on a variety of developing legal areas, including, creating, and implementing scalable telemedicine programs.
